Change To Retention Area Procedures

On Monday (March 8), the Canadian Pari-Mutuel Agency (CPMA) issued a release advising of changes to the retention area procedure effective next month at racetracks across the country.

The Canadian Pari-Mutuel Agency is advising the Canadian horseracing industry that as of April 1, 2021, when a Test Inspector (TI) takes control of a horse in the retention area, they will ask the horse handler if they are aware of their rights to witness the sample collection, sealing and identification, rather than reading them those rights. If the person replies that they are not aware, the TI will refer them to a poster that is prominently displayed that describes those rights. The TI will also answer any questions the handler may have.

There are no changes to the Pari-Mutuel Betting Supervision Regulations or to a sample witness’ rights. The owner or trainer of a horse chosen to undergo a test, or their representative, may continue to:

(a) witness the collection of the official sample;

(b) witness the sealing and identification of the official sample container; and

(c) sign the documentation that accompanies the official sample.

With respect to paragraph (c) above, horsepersons will continue to provide their name and license number to the Test Inspector in lieu of a signature as witness to the sample collection.

Changement à une procédure dans l’enclos (le 8 mars 2021)

L’agence canadienne du pari mutuel (ACPM) désire aviser l’industrie canadienne des courses de chevaux que dès le 1er avril 2021, quand l’inspecteur des prélèvements prendra le contrôle du cheval dans l’enclos, il demandera au représentant s’il est au courant de ses droits relatif au prélèvement, fermeture et identification des échantillons au lieu de lui lire ces droits. Si la personne répond qu’elle n’est pas au courant, l’inspecteur la réfèrera à une pancarte affichée bien en vue qui décrit ces droits. L’inspecteur répondra aussi aux questions demandées.

Il n’y aucun changement au Règlement sur la surveillance du pari mutuel ou aux droits du témoin du prélèvement. Le propriétaire, entraineur ou représentant du cheval choisi pour passer au test continuera à avoir le droit d’

a) assister au prélèvement de l’échantillon officiel;

b) assister à l’apposition du sceau et des données d’identification sur le contenant de l’échantillon officiel; et

c) apposer sa signature sur les documents qui accompagnent l’échantillon officiel.

Pour l’alinéa c) ci-dessus, les représentants continueront de fournir leur nom et numéro de permis à l’inspecteur de prélèvements à la place d’une signature comme témoin du prélèvement de l’échantillon.
